1. How does a ‘no win no fee’ claim work?

Liverpool Legal will only receive payment for its services, if you are successful in your claim for compensation.
If you were to lose your case, you would not usually have any legal fees to pay to Liverpool Legal in line with our ‘No Win No Fee’ agreement. We take this risk on your behalf. There may, however, subject to the insurance which covers your claim, be disbursements or legal fees of the other side to pay.
2. Do I have to pay the other side if I lose?
If your claim is for personal injury and it does not succeed, you will not usually be required to pay for the other side’s legal fees if you lose. This is because personal injury claims are covered by qualified one-way costs shifting, which means that unless the claim is fundamentally dishonest, is for the benefit of a 3rd party or is struck out, a Court will not permit any costs orders to be enforced against you. This means you usually will not have to pay the other side’s legal fees even if you lose.
If your claim is for any other type of litigation, such as professional negligence, property, probate or commercial litigation, you will still be required to pay the other side’s legal fees if you were to lose the claim. We can assist you consider insurance to protect you from this risk.
3. How will I fund my ‘no win, no fee ‘compensation claim?
A conditional fee agreement is also known as a ‘no win, no fee’ agreement. It covers the legal fees of Liverpool Lega incurred in bringing your claim. However, it does not cover legal fees of the other side or disbursements. We will always investigate the possibility of protecting you from these risks by funding your case through a legal expense insurance policy you may already have or obtaining a policy from a legal expenses insurance provider.
Such a policy may also pay for some of the additional expenses, known as disbursements, such as for court fees and medical reports. You may even already have a building or contents policy that will cover you for legal fees up to a certain limit. Liverpool Legal will explore your options with you and will look at your insurance documents for you and advise you about whether you have the necessary cover in place.
There are no upfront payments and Liverpool Legal will help you to arrange a suitable insurance policy, if it is required.
4. Am I able to choose the solicitors firm that I would prefer to use, if I already have insurance cover available to me?
Your insurers may try to allocate a firm to you from their own panel solicitors. However, the law is clear that you can instruct a solicitor of your own choice from the start of your claim. Liverpool Legal solicitors are happy to liaise with your insurer about your case if you have that funding available to you. We understand that it is important for clients to feel comfortable with the solicitor that is acting on their behalf.
5. If my claim is successful, how and when would I be expected to pay Liverpool Legal for its assistance?
If your compensation claim is successful, the basic fees will be recovered from the person or company that is responsible for causing your injury. These fees are usually fixed by rules governing how such claims are brought.
Upon conclusion of your matter and in line with our agreement. The amount that you will pay is capped at 25% but may be lower than that depending upon the individual circumstances and risk factors in your case. The success fee is only paid to us when we have successfully helped you to win your compensation claim.
